General Terms and Conditions of Ordering from Coach Companies
These “General Terms and Conditions of Ordering from Coach Company” apply between consumer, the coach company and My Bus Food when the consumer takes an order through My Bus Food’s app.
1. Definitions
Offer: the range of food and beverages and care of their ordering and payment which is offered by the coach companies through the My Bus Food platform.
App: the mobile application (app) where consumers can order food and drinks from the coach companies.
Order: an order placed by the consumer on the app with the coach company.
Payment: Payments through the payment options offered by My Bus Food through the app: iDEAL, credit card, PayPal and on account.
Consumer: the person who takes an order from the coach company through the app.
Host: the employee of the coach company who handles the order.
My Bus Food: the company My Bus Food offering the app is located at Ruys de Beerenbroucklaan 3C, 6417 CC in Heerlen and registered with the Chamber of Commerce under number 80118186 and our VAT number is NL003401134B60.
Agreement: once the consumer places an order through the app, the consumer enters into an agreement with the coach company which provides that the consumer will purchase and pay for the order and the host will prepare, service and deliver the order.
Products: the food and drinks offered by the coach companies through the app.
Coach company: the coach company affiliated with My Bus Food that prepares food and beverages and with which the consumer enters into the contract.
2. Applicability of General Terms and Conditions of Ordering from Coach Companies.
These terms and conditions apply to Ordering from the Coach Companies through the App.
Every Consumer who places an Order via the App and thereby concludes an Agreement with the selected Touring Company accepts the applicability of these General Terms and Conditions of Ordering with Touring Companies (hereinafter: Terms and Conditions of Ordering with Touring Companies).
If any provision in these Terms and Conditions of Ordering with Touring Car Companies is void or nullified, the remaining provisions shall remain in full force and effect. The replacement provision(s) will approximate the purpose and scope of the void or voided provision as much as possible.
Departures from the provisions of these Terms and Conditions of Ordering from Coach Companies may only be made in writing. In that case, the other provisions remain fully applicable.

3. Offering Coach Companies
Consumer acknowledges that by ordering through the App, an Agreement is created between the Consumer and the selected Coach Company and that My Bus Food is/will not be a party to the Agreement.
In the My Bus Food App, Consumers will find all the information about the range of food and beverages offered by the member Coach companies.
4. Establishment and cancellation of an Order.
The Contract with a Consumer is established once the Consumer has clicked on “Pay” in the App and agreed to the terms and conditions of the Coach Company. This makes the Order final.
The Coach Company will then receive a notification that an Order has been placed.
The Consumer pays the amount to the Coach Company as shown in the App. This amount including transaction fees is clearly visible. The payment options offered to the Consumer are iDEAL, credit card, PayPal and on account. When the Consumer orders on account, the Consumer pays the amount in cash to the Touring Company.
How the delivery is carried out is at the expense of the Touring Company, never at the expense of My Bus Food.
The Coach Company has the right to cancel the Order if:
the Consumer provided inaccurate information;
due to an unforeseen circumstance: the Product is no longer available and an alternative is not accepted by the Consumer;
there is force majeure;
The Coach Company will have any amounts already paid by the Consumer refunded upon cancellation.
Possible cancellation costs incurred by the Touring Company consisting at least of the value of the Order may be passed on by the Touring Company to the Consumer if the cancellation is caused by the provision of incorrect data by the Consumer.
5. Touring Car Company’s obligations to Consumer.
The Coach Company is to the Consumer courteous, respectful and has customer satisfaction at all times.
The Coach Company is available to the Consumer by email, app or phone during business hours.
The Products must be safe for consumption, hygienically prepared and packaged and correspond to what the Consumer ordered.
Once an Order is placed through the App, the Touring Company is obliged to process the Order, unless there is a (valid) cancellation or force majeure. The Coach Company will notify the Consumer as soon as possible, in any case within 20 minutes of receiving the Order. The Coach Company is obliged to propose an alternative to the Consumer. This also applies if the Products are (temporarily) not (partially) available. Any costs incurred as a result will be the sole responsibility of the Touring Company, never My Bus Food.
Possible transaction fees will be stated by the Touring Company.
The Coach Company shall ensure that the Order is delivered to the Consumer in a timely manner. In any case, timely means that the Order is delivered to the Consumer within 1 (one) hour.
For an Order containing alcoholic beverages or other Products with an age limit, the Coach Company is required to request valid identification as required by law. If a Consumer cannot or will not provide identification, the Coach Company will not provide the Products to the Consumer.
The Coach Company provides a receipt (invoice) of what the Consumer ordered (digital or printed).
6. Obligations of Consumer towards Touring Company.
Once Consumer has clicked on “Pay” in the App and has agreed to the Terms and Conditions of Ordering from Coach Companies, the Agreement is established. This makes the Order final.
In the App, the Consumer will find the status of the Order on the ‘Orders’ page. In order to keep the status up to date, the Consumer must be easily accessible via the contact information (phone number/email) provided by the Consumer.
In order to correctly process the Order, the Host of the Coach Company requires certain information provided by the Consumer such as last name and the seat number where the Consumer sits on the coach. Therefore, it is important that the Consumer fill in this information correctly.
If the information entered by the Consumer is found to be incorrect, the Touring Company may not be able to properly take the Order and cancel it. See also Article 5(4) for this purpose.
For an Order containing alcoholic beverages or other Products with an age limit, Consumer must present identification as required by law: Consumer must be at least 18 years of age and older. Both while ordering and while delivering alcoholic beverages or other Products with an age limit, Consumer shall identify himself. If the Consumer fails to do so, or if it appears upon delivery that the Consumer is not of the minimum age as required by law, the Consumer will not receive the alcoholic beverages or other Products. The possible cancellation costs incurred by the Coach Company as a result and at least the value of the alcoholic beverages or other Products with an age limit shall be borne by the Consumer.
7. Cancellation and/or dissolution of the Agreement by Consumer.
The possibility of canceling the Order or rescinding the concluded Agreement with a Coach Company is reserved to the respective Coach Company. Consumer should contact the Coach Company for this purpose. My Bus Food has no control over that.
8. Complaints
Complaints about a Coach Company’s service can be made by the Consumer via both https://mybusfood.com/klantenservice/klachten/ and via the App on the help page via ‘submit complaint’. Here the Consumer describes as specifically as possible what the complaint consists of so that the Coach Company can respond appropriately.
The Coach Company will respond to the complaint no later than 72 hours.
9. Applicable law
The Contracts between the Coach Company and Consumers are governed exclusively by Dutch law.
Any disputes that may arise between the Touring Company and the Consumer as a result of a concluded Agreement will be submitted to the competent court.
The Dutch text of the general terms and conditions is always decisive for their interpretation.
10. Modification of Conditions of Ordering from Coach Companies.
My Bus Food may change its terms and conditions from time to time. The amended Conditions of Ordering from Coach Companies will be applicable once published through the App and on the website. As soon as Consumer places an Order via the App, Consumer thereby accepts the applicability of the modified Terms and Conditions of Ordering from Coach Companies.
